Home > Members > Membership contract Membership contractThis is an agreement between you (applying for a Software Industry Professionals membership) and Multimedia Australia Pty. Ltd. ACN 096 830 394 (operating on this site under the trademark "Software Industry Professionals"). By registering to become a Software Industry Professionals member, you acknowledge that you have read and agree to this membership contract. Software Industry Professional members should always act legally and ethically while conducting business. This includes but is not limited to:
Membership duration and costGold and Silver memberships commence on the date of joining/upgrading and run for a period of 1 calendar year. Gold and Silver members must pay the prescribed membership fee, and renew their membership before it expires. Gold and Silver memberships that expire will either 1) enter a suspended mode and may eventually be cancelled if not renewed; or 2) revert to Standard memberships if you joined prior to 1 November 2009. Standard 'Software Industry Professionals Member' memberships commence on the date of registration and run until the 31 December of that year, and are renewed automatically for a further year until cancelled. A standard 'Software Industry Professionals Member' membership is free. Describing yourself as a Software Industry Professionals memberIf your application is accepted (including if you are accepted automatically online), you may call yourself a 'Software Industry Professionals Member' for the duration of your membership, and you may display the Software Industry Professionals Member logo (whichever is applicable for your membership level: either Standard, Silver or Gold) on your website, marketing materials and stationery. Multimedia Australia shall not be liable for any costs that may be associated with re-printing, removing or otherwise modifying any material containing the membership logo if your membership is cancelled. Nature of membershipThe meaning of "membership" refers to having subscription access to the Software Industry Professionals online service, namely access to the Members' Area for the period of the membership duration. Membership does not give you any rights or interests whatsoever in the Software Industry Professionals group, services or associated assets. All rights and interests remain with Multimedia Australia Pty. Ltd. Gold and Silver MembershipsIf you choose a Gold or Silver membership, we will endeavour to set up your membership and send your associated membership certificate (supplied electronically by email) in less than 1 business day. However, during periods of high demand, please expect up to 3-5 business days for your membership to be set up. The 1 year Gold and Silver membership periods commence from the date your membership is provided to you, not the date of ordering. If you are a Standard member and upgrade to a Gold or Silver membership level, your original username and password will apply to access the Members' Area. Optional software submissionsIf you choose to submit your software to the Software Industry Professionals website (by submitting your PAD file or through any through other means that may be provided), you declare that you hold complete title and other applicable intellectual property rights to the software and that you authorise Software Industry Professionals to automatically poll your PAD file URLs for updates on a routine basis, list the software you submit on the Software Industry Professionals website (and if applicable, other software promotion websites), and make your PAD file URLs/listings available to third party download sites. The Software Industry Professionals may remove a submission for any reason without prior notice. You warrant that you have made every reasonable effort to ensure the software is of good quality and is free from viruses and spyware. You may not submit another party's software to your own Software Industry Professionals Member's area login. Receipt of emailThe Software Industry Professionals group may send you occasional emails regarding your membership (eg: a monthly Member's newsletter). Your details will remain confidential and will not be disclosed to third parties. Joinder with terms of use, privacy statement and disclaimerThe Software Industry Professionals website terms of use, privacy statement and disclaimer form part of this contract. By accepting this contract, you acknowledge that you have read and agree to the terms they contain. Cancellation of membershipSoftware Industry Professionals members will have their membership cancelled if it becomes apparent that they have acted unethically, illegally, or breach this contract. Upon cancellation, the member, at their expense, must within 30 days remove any references they might have made to the Software Industry Professionals (including but not limited to seals, logos and statements) on their stationery, websites, software products etc. Any membership fees paid will not be refunded under these circumstances. Refund policyIf purchasing a Gold or Silver membership, we ask that you please choose carefully before making your purchase, as we do not normally give refunds if you simply change your mind or make a wrong selection. Software Industry Professionals is a Multimedia Australia service, and Multimedia Australia's standard refund policy applies. For details, please go to http://www.mmau.com/refundpolicy.php. Updates to this contractThis contract may be updated from time to time. You will be notified of any updates when you log in to your membership area. It is your responsibility to read any modifications to the contract that may be made in the future. Continued use of the Software Industry Professionals website or services upon the release of an updated contract will be considered your acceptance of that contract.
